Basic formalities to be complied with

For each employee seconded by a company, it is necessary to:

  • Complete a declaration in advance
This must be provided to the employee before the start of the assignment abroad.
  • Appoint a local representative
Whether you want to second your employees to France or Italy, you need to appoint a representative in the destination country. The representative will be an essential link between the company and the authorities, and his or her role will be to provide the necessary documents in the event of checks by the labour inspectorate, the police or the gendarmerie.

What are the requirements for posting employees?

By seconding employees to another European country, the employer must comply with the regulations of the country of secondment, in terms of: working hours, pay, safety conditions, accommodation, etc…

Today, many companies are choosing these solutions for a variety of reasons, developing a business, carrying out intra-company work … With so many employees, the laws concerning this operating system are being tightened.

The Future Act of September 2018 is a case in point. It has contributed to the tightening of the rules on penalties. For example, failure to comply with the obligations will result in heavy penalties, ranging from €4,000 to €8,000. A blacklist has even been set up, enabling companies with a history of illegal employment offences to be reported.
