Curfew in France, new supporting documents for seconded employees

The health situation linked to the Coronavirus continues to deteriorate in France. Despite the various measures previously introduced by the government, the number of cases of contamination in France is rising daily. For this reason, a curfew has just been introduced. The aim of this new restrictive measure is to limit social interaction.

Curfew: the new restrictive measure imposed in France

Faced with an increase in the number of people infected in France since the start of the autumn, the French government has introduced new measures to actively combat the spread of the virus.

On Wednesday 14 October 2020, French President Emmanuel Macron announced the introduction of a curfew between 9pm and 6am.

This restriction will apply from Saturday 24 October 2020 and will last for a minimum of 4 weeks in the following departments:

Ain (01), Hautes-Alpes (05), Alpes-Maritimes (06), Ardèche (07), Ardennes (08), Ariège (09), Aube (10), Aveyron (12), Bouches-du-Rhône (13), Calvados (14), Corse-du-Sud (2A), Haute-Corse (2B), Côte-d’Or (21), Drôme (26), Gard (30), Haute-Garonne (31), Hérault (34), Ille-et-Vilaine (35), Indre-et-Loire (37), Isère (38), Jura (39), Loire (42), Haute-Loire (43), Loiret (45), Lozère (48), Maine-et-Loire (49), Marne (51), Meurthe-et-Moselle (54), Nord (59), Oise (60), Pas-de-Calais (62), Puy-de-Dôme (63), Pyrénées-Atlantiques (64), Hautes-Pyrénées (65), Pyrénées-Orientales (66), Bas-Rhin (67), Rhône (69), Saône-et-Loire (71), Savoie (73), Haute-Savoie (74), Paris (75), Seine-Maritime (76), Seine-et-Marne (77), Yvelines (78), Tarn (81), Tarn-et-Garonne (82), Var (83), Vaucluse (84), Haute-Vienne (87), Essonne (91), Hauts-de-Seine (92), Seine-Saint-Denis (93), Val-de-Marne (94), Val-d’Oise (95) and French Polynesia (987).

Secondment of workers and curfew

As was the case during the lockdown in March, employers may issue proof of travel when the seconded employees’ work cannot be postponed. Or when it is essential for them to travel to carry out activities that cannot be organised in the form of teleworking between 9 p.m. and 6 a.m.

Therefore, during this curfew period, seconded employees only need to fill in the proof of business travel. This must be provided to the authorities in the event of an inspection.

On the other hand, if the workers are self-employed or self-employed, they will also have to fill in the derogation travel certificate by ticking box 1 (Travel between home and place of work or place of education and training).

These documents must be made available to the police in the event of an inspection. An identity document may also be requested, as well as any other proof of travel.

Penalties for breaking the curfew

In the event of non-compliance with the curfew or failure to produce proof of identity and/or the certificate, the French Ministry of the Interior imposes the following penalties:

  • A fine of €135, which may be increased to €375 if the fine is not paid or not contested within the period specified on the ticket.
  • In the event of a repeat offence within 15 days, the fine will be €200, increased to €450.
  • Following 3 offences within 30 days, the penalties are a fine of €3,750 and 6 months’ imprisonment.
