Posting of workers: new decree published in the France’s Official Journal

Worker secondment: the new decree of 28 July 2020, published in the Journal Officiel, came into force on 30 July 2020 and aims to combat unfair competition.

The decree includes the following provisions:

  • Employers seconding employees must now cover the professional expenses incurred by the seconded employee (transport, meals and accommodation).
  • The declaration procedures and conditions for issuing the professional identification card (BTP card in the construction and public works sector) have changed;
  • The Direccte (Directions régionales des entreprises, de la concurrence, de la consommation, du travail et de l’emploi – France’s Regional Directorates for Business, Competition, Consumer Affairs, Labour and Employment) have been given greater powers to impose penalties.
