{"id":18785,"date":"2020-09-30T12:48:09","date_gmt":"2020-09-30T12:48:09","guid":{"rendered":"https:\/\/soposting-worker.com\/?p=18785"},"modified":"2024-11-06T09:11:45","modified_gmt":"2024-11-06T09:11:45","slug":"detachement-en-france-nouvelle-reglementation","status":"publish","type":"post","link":"https:\/\/soposting-worker.com\/fr\/detachement-en-france-nouvelle-reglementation\/","title":{"rendered":"D\u00e9tachement en France : Nouvelle r\u00e9glementation"},"content":{"rendered":"\n<p>Depuis le 30 juillet 2020, de <strong>nouvelles r\u00e8gles concernant le d\u00e9tachement en France<\/strong> sont entr\u00e9es en vigueur avec le\u00a0<a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do?cidTexte=JORFTEXT000042165144\" target=\"_blank\" rel=\"noreferrer noopener\">d\u00e9cret du 28 juillet 2020<\/a>.\u00a0 Ces derni\u00e8res, visant \u00e0 lutter contre la concurrence d\u00e9loyale, \u00e9voluent et se renforcent.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Extension de r\u00e8gles applicables aux salari\u00e9s d\u00e9tach\u00e9s<\/h2>\n\n\n\n<p>Avec l\u2019adoption de ce nouveau d\u00e9cret, les <strong>dispositions l\u00e9gales et conventionnelles du d\u00e9tachement se durcissent<\/strong>. En effet, les travailleurs d\u00e9tach\u00e9s b\u00e9n\u00e9ficieront de r\u00e8gles plus avantageuses en mati\u00e8re de r\u00e9mun\u00e9ration. Fini la r\u00e9f\u00e9rence au salaire minimum, ils devront d\u00e9sormais b\u00e9n\u00e9ficier d\u2019une \u00e9galit\u00e9 de traitement avec les salari\u00e9s relevant de la m\u00eame branche d\u2019activit\u00e9 sur le sol fran\u00e7ais.\u00a0<\/p>\n\n\n\n<p>D\u2019autre part, la dur\u00e9e d\u2019application des dispositions l\u00e9gales relative \u00e0 un d\u00e9tachement\u00a0\u00e9tait, jusqu&rsquo;\u00e0 pr\u00e9sent, applicable sur une dur\u00e9e de vingt-quatre mois. Dor\u00e9navant, ces dispositions sont limit\u00e9es \u00e0 douze mois. Pass\u00e9 de d\u00e9lais, soit \u00e0 compter du treizi\u00e8me mois, <strong>l\u2019employeur d\u00e9tachant temporairement un salari\u00e9 en France sera soumis \u00e0 la quasi-totalit\u00e9 des dispositions du Code du travail<\/strong>. Except\u00e9 pour\u00a0les dispositions relatives \u00e0\u00a0:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>la formation et l\u2019ex\u00e9cution du contrat de travail&nbsp;;<\/li>\n\n\n\n<li>la modification du contrat de travail pour motif \u00e9conomique&nbsp;;<\/li>\n\n\n\n<li>la mobilit\u00e9 volontaire s\u00e9curis\u00e9e&nbsp;;<\/li>\n\n\n\n<li>le transfert et la rupture du contrat de travail&nbsp;;<\/li>\n\n\n\n<li>les CDD&nbsp;;<\/li>\n\n\n\n<li>les contrats de chantier.<\/li>\n<\/ul>\n\n\n\n<p>Une prolongation de six mois maximum sera possible lorsque la situation le justifie. Dans ce cas, l\u2019employeur devra adresser une d\u00e9claration motiv\u00e9e \u00e0 l&rsquo;autorit\u00e9 administrative. \u00c0 d\u00e9faut, l&#8217;employeur sera passible d&rsquo;une amende administrative de 4 000 \u20ac par salari\u00e9, port\u00e9 \u00e0 8 000 \u20ac par salari\u00e9 en cas de r\u00e9cidive dans les deux ans, et dans une limite de 500 000 \u20ac.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Les frais professionnels engag\u00e9s pris en charge par l\u2019employeur&nbsp;<\/h2>\n\n\n\n<p>La base des droits applicables aux salari\u00e9s d\u00e9tach\u00e9s s\u2019est \u00e9tendue afin d\u2019y <strong>int\u00e9grer les remboursements des frais professionnels engag\u00e9s par les salari\u00e9s d\u00e9tach\u00e9s dans l\u2019exercice de leur mission<\/strong> en mati\u00e8re de transport, de repas, et d\u2019h\u00e9bergement.\u00a0<\/p>\n\n\n\n<p>Ces d\u00e9penses sont prises en charge par l\u2019employeur et sont vers\u00e9es en plus de la r\u00e9mun\u00e9ration.<\/p>\n\n\n\n<p>Par ailleurs, cette prise en charge par l\u2019entreprise est obligatoire et d\u00e9pend des conditions cumulatives suivantes&nbsp;:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>elle doit \u00eatre pr\u00e9vue dans les dispositions l\u00e9gales ou des stipulations conventionnelles.<\/li>\n\n\n\n<li>Le salari\u00e9 d\u00e9tach\u00e9 doit se d\u00e9placer vers ou depuis son lieu de travail habituel sur le territoire national ou lorsqu\u2019il est temporairement envoy\u00e9 par son employeur de ce lieu de travail habituel vers un autre lieu de travail.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">D\u00e9tachement dans la branche du travail temporaire<\/h3>\n\n\n\n<p>De nouvelles obligations sont constitu\u00e9es en cas de recours \u00e0 des travailleurs d\u00e9tach\u00e9s int\u00e9rimaire.<\/p>\n\n\n\n<p>Pour le d\u00e9tachement dit \u00ab&nbsp;direct&nbsp;\u00bb, l\u2019entreprise utilisatrice \u00e9tablie en France ayant recours \u00e0 des salari\u00e9s d\u00e9tach\u00e9s d\u2019une entreprise de travail temporaire (ETT) \u00e9tablie \u00e0 l\u2019\u00e9tranger, devra obligatoirement informer cette derni\u00e8re des r\u00e8gles applicables sur le territoire fran\u00e7ais notamment en mati\u00e8re de r\u00e9mun\u00e9ration, pour toute la dur\u00e9e du d\u00e9tachement.&nbsp;<\/p>\n\n\n\n<p>Pour le d\u00e9tachement dit \u00ab&nbsp;indirect&nbsp;\u00bb l\u2019entreprise utilisatrice \u00e9tablie \u00e0 l\u2019\u00e9tranger et exer\u00e7ant de mani\u00e8re ponctuelle une activit\u00e9 en France devra simplement informer l\u2019ETT \u00e9trang\u00e8re des r\u00e8gles applicables en France.<\/p>\n\n\n\n<p>Concernant le secteur du BTP, il appartient d\u00e9sormais \u00e0 l\u2019employeur d\u2019effectuer une d\u00e9claration pour chaque salari\u00e9, en vue d\u2019obtenir une\u00a0<a href=\"https:\/\/www.soposting-worker.com\/fr\/carte-btp\" target=\"_blank\" rel=\"noreferrer noopener\">carte BTP<\/a>. Cette d\u00e9marche doit d\u00e9sormais, \u00eatre effectu\u00e9e par voie d\u00e9mat\u00e9rialis\u00e9e. En compl\u00e9ment des informations d\u00e9j\u00e0 obtenus via la d\u00e9claration de d\u00e9tachement, la demande doit \u00eatre accompagn\u00e9e de\u00a0la photographie d\u2019identit\u00e9 et le cas \u00e9ch\u00e9ant le num\u00e9ro de l\u2019autorisation du travail ou de la carte de s\u00e9jour valant autorisation de travail.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">D\u00e9claration de d\u00e9tachement, les obligations du donneur d\u2019ordre<\/h2>\n\n\n\n<p>Le donneur d\u2019ordre ou ma\u00eetre d\u2019ouvrage devra s\u2019assurer&nbsp;:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>du respect de ses obligations de vigilance&nbsp;;<\/li>\n\n\n\n<li>d\u00e9clarer tout accident du travail&nbsp;;<\/li>\n\n\n\n<li>afficher la r\u00e9glementation sur les chantiers du b\u00e2timent ou du g\u00e9nie civil.<\/li>\n<\/ul>\n\n\n\n<p>Par ailleurs, dans la cadre de son obligation de vigilance, le donneur d\u2019ordre ou ma\u00eetre d\u2019ouvrage devra syst\u00e9matiquement demander avant le d\u00e9but de chaque d\u00e9tachement un accus\u00e9 de r\u00e9ception de la d\u00e9claration de d\u00e9tachement aupr\u00e8s de ses sous-traitants directs ou indirects, ainsi qu\u2019aux ETT d\u00e9tachant des salari\u00e9s. Cette derni\u00e8re devra \u00eatre annex\u00e9 au registre du personnel. De plus, dans le cas o\u00f9 l\u2019employeur \u00e9tranger ne fournit pas cet accus\u00e9 de r\u00e9ception, le ma\u00eetre d\u2019ouvrage ou donneur d\u2019ordre devra effectuer la d\u00e9claration subsidiaire de d\u00e9tachement.&nbsp;<\/p>\n\n\n\n<p>En cas, de manquement \u00e0 ses obligations, le donneur d\u2019ordre ou ma\u00eetre d\u2019ouvrage s\u2019exposera \u00e0 des sanctions.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sanctions en cas de non-respect des obligations pr\u00e9vues<\/h2>\n\n\n\n<p>Le code du travail pr\u00e9voit des sanctions \u00e0 l\u2019encontre de l\u2019entreprise d\u00e9tachant des salari\u00e9s, mais \u00e9galement du ma\u00eetre d\u2019ouvrage ou du donneur d\u2019ordre en France, en cas de non-respect des obligations pr\u00e9vues dans le cadre d\u2019un d\u00e9tachement de salari\u00e9s.&nbsp;<\/p>\n\n\n\n<p>Dans le cas o\u00f9 les r\u00e8gles relatives au d\u00e9tachement ne seraient pas respect\u00e9es, diff\u00e9rentes sanctions peuvent \u00eatre prononc\u00e9es&nbsp;:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>l\u2019interdiction ou la suspension de la prestation en cas de manquement grave aux r\u00e8gles de d\u00e9tachement.<\/li>\n\n\n\n<li>Des amendes administratives.<\/li>\n<\/ul>\n\n\n\n<p>Avec son service en ligne So Posting Worker, ASD Group vous propose de prendre en charge l\u2019ensemble des obligations relatives au d\u00e9tachement de salari\u00e9s. En effet, le d\u00e9tachement au sein du secteur du transport routier, est sujet \u00e0 une l\u00e9gislation propre. Ce dernier est soumis \u00e0 des modalit\u00e9s sp\u00e9cifiques adopt\u00e9es en juillet 2020 par le Parlement europ\u00e9en.&nbsp;<\/p>\n\n\n\n<p>Pour plus d\u2019information sur cette
