{"id":27626,"date":"2024-04-25T06:23:55","date_gmt":"2024-04-25T06:23:55","guid":{"rendered":"https:\/\/soposting-worker.com\/?post_type=actualite&#038;p=27626"},"modified":"2024-04-25T08:21:14","modified_gmt":"2024-04-25T08:21:14","slug":"france-changements-dans-la-carte-btp","status":"publish","type":"actualite","link":"https:\/\/soposting-worker.com\/fr\/france-changements-dans-la-carte-btp\/","title":{"rendered":"France : Changements dans la Carte BTP"},"content":{"rendered":"\n<p>Depuis 2015, tout&nbsp;<strong>travailleur \u00e9tranger d\u00e9tach\u00e9 en France<\/strong>&nbsp;pour des activit\u00e9s dans le domaine du b\u00e2timent ou des travaux publics <strong>doit \u00eatre&nbsp;muni d\u2019une carte BTP valide pour chaque chantier sur lequel il intervient<\/strong>. Ainsi, chaque employeur est tenu de <strong>commander une carte BTP pour chaque salari\u00e9 et pour chaque chantier<\/strong> distinct lors de chaque d\u00e9tachement.<br><br>Cependant, la loi n\u00b0 2015-990 du 6 ao\u00fbt 2015 qui a instaur\u00e9 la Carte d\u2019Identification Professionnelle pour les travailleurs du BTP, commun\u00e9ment appel\u00e9e <strong>la Carte BTP,&nbsp;fait l\u2019objet d\u2019une r\u00e9forme<\/strong>&nbsp;selon le d\u00e9cret n\u00b0 2024-112 du 15 f\u00e9vrier 2024 et qui&nbsp;entre en vigueur le 1er avril 2024.<\/p>\n\n\n\n<p>Voici les modifications qui prennent effet \u00e0 partir du 1er avril 2024 :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Dur\u00e9e de validit\u00e9 des cartes BTP<\/strong><br>Afin de simplifier les proc\u00e9dures, \u00e0 partir du 1er avril 2024, les employ\u00e9s travaillant pour un employeur bas\u00e9 \u00e0 l\u2019\u00e9tranger et r\u00e9alisant des travaux de construction ou de travaux publics en France devront poss\u00e9der une carte BTP valide pendant cinq ans (conform\u00e9ment \u00e0 l\u2019Article R. 8292-3 du Code du travail). La dur\u00e9e de validit\u00e9 ainsi que la date d\u2019expiration seront indiqu\u00e9es sur chaque carte BTP.<br><\/li>\n\n\n\n<li><strong>Multi-missions<\/strong><br>Toutefois, la carte sera d\u00e9sactiv\u00e9e entre chaque p\u00e9riode de d\u00e9tachement et entre deux missions pour les salari\u00e9s int\u00e9rimaires travaillant pour des agences de travail temporaire \u00e9tablies en France. Cette disposition entra\u00eene une modification de l\u2019article R. 8292-3 2\u00b0 du Code du travail.<br><\/li>\n\n\n\n<li><strong>Multi-employeurs<\/strong><br>Pour r\u00e9pondre \u00e0 cette exigence, la carte BTP sera d\u00e9sormais multi-employeurs, permettant ainsi l\u2019enregistrement d\u2019un nombre illimit\u00e9 de d\u00e9tachements et de chantiers, qui seront ajout\u00e9s au fur et \u00e0 mesure.<br><\/li>\n\n\n\n<li><strong>Lieux de missions supprim\u00e9s<\/strong><br>Les cartes BTP ne mentionneront plus les lieux des d\u00e9tachements. Ces informations seront exclusivement disponibles sur les d\u00e9clarations SIPSI.<br><\/li>\n\n\n\n<li><strong>Gestionnaire des cartes BTP modifi\u00e9<\/strong><br>Le responsable de la d\u00e9livrance des cartes BTP change : ce sera d\u00e9sormais l\u2019association \u00ab CIBTP France \u2013 Cong\u00e9s Intemp\u00e9ries BTP France \u00bb, charg\u00e9e de la gestion administrative, technique et financi\u00e8re de cette carte, et non plus l\u2019Union des Caisses, comme stipul\u00e9 \u00e0 l\u2019Article R.8291-2 du Code du travail.<\/li>\n<\/ul>\n\n\n\n<p>Ce qui reste inchang\u00e9 \u00e0 partir du 1er avril 2024 :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Les employeurs \u00e9trangers d\u00e9tachant des salari\u00e9s doivent toujours&nbsp;<strong>soumettre une demande \u00e0 l\u2019association \u00ab CIBTP France \u00bb pour obtenir des cartes BTP<\/strong>, moyennant le paiement d\u2019une redevance dont le montant est fix\u00e9 par ladite association, conform\u00e9ment \u00e0 l\u2019Article R.8291-3 du Code du travail.<br><\/li>\n\n\n\n<li>Tel que pr\u00e9c\u00e9demment, en attendant la d\u00e9livrance de la carte d\u2019identification professionnelle,&nbsp;<strong>une attestation provisoire, \u00e9quivalant \u00e0 une carte d\u2019identification professionnelle, est transmise&nbsp;\u00e9lectroniquement par l\u2019association \u00ab CIBTP France \u00bb<\/strong> \u00e0 l\u2019employeur ou \u00e0 son repr\u00e9sentant, afin d\u2019\u00eatre remise au salari\u00e9 concern\u00e9.<br><\/li>\n\n\n\n<li>Le d\u00e9tenteur de la carte d\u2019identification professionnelle ou de l\u2019attestation provisoire <strong>doit&nbsp;la pr\u00e9senter imm\u00e9diatement \u00e0 toute demande des agents de contr\u00f4le<\/strong>&nbsp;mentionn\u00e9s \u00e0 l\u2019article L. 8271-1-2 du Code du travail.<\/li>\n<\/ul>\n\n\n\n<p>Pour plus d\u2019informations, n\u2019h\u00e9sitez pas \u00e0\u00a0<a href=\"https:\/\/soposting-worker.com\/fr\/contact\/\">contacter nos experts<\/a>\u00a0!<\/p>\n\n\n\n<p>Sources :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.legifrance.gouv.fr\/download\/file\/W4iHY0uxkQIwQpA2B7hi3txJZvxKXBoNLUNa3sUly-c=\/JOE_TEXTE\">L\u00e9gifrance<\/a>&nbsp;\/&nbsp;<a href=\"https:\/\/www.cibtp.fr\/carte-btp\/nouveautes-2024\">CIBTP<\/a><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Depuis 2015, tout&nbsp;travailleur \u00e9tranger d\u00e9tach\u00e9 en France&nbsp;pour des activit\u00e9s dans le domaine du b\u00e2timent ou des travaux publics doit \u00eatre&nbsp;muni d\u2019une carte BTP valide pour chaque chantier sur lequel il intervient.
